Terms of Service

1. Acceptance of Terms
Packstack, LLC ("Packstack," "we," "us," or "our") operates the website www.packstack.io, the web application at app.packstack.io, and the Packstack mobile application (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
2. The Service
Packstack is a packing list and gear management platform designed for backpackers and ultralight hikers. The Service allows you to build gear inventories, create and share packing lists, plan trips, and track pack weight — available through our website, web application, and mobile app.
3. Accounts
To access most features of the Service, you must create an account using a supported social login provider (such as Google or Apple). You are responsible for maintaining the security of your account and for all activities that occur under it. You agree to notify us immediately at support@packstack.io if you suspect unauthorized use of your account.
Each individual may maintain only one account. We reserve the right to suspend or terminate duplicate accounts.
4. Subscriptions and Billing
Packstack offers both free and paid tiers. The paid subscription is available at $29.99 per year.
- Auto-Renewal — Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
- Cancellation — You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features through the end of your current billing period.
- Refunds — Subscription fees are non-refundable. No prorated refunds will be issued for partial billing periods.
- Price Changes — We reserve the right to change subscription pricing. If we do, we will provide at least 30 days' notice before the new price takes effect. Your continued subscription after the price change constitutes acceptance of the new pricing.
5. User Content
"User Content" means any data you create, upload, or store through the Service, including gear inventories, packing lists, trip plans, photos, and notes.
Ownership — You retain all ownership rights to your User Content.
License Grant — By using the Service, you grant Packstack a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your User Content solely as necessary to operate and provide the Service. If you use sharing features (e.g., sharing a packing list publicly or with other users), your User Content will be visible to the intended recipients.
Content Removal — We reserve the right to remove any User Content that violates these Terms or that we reasonably believe is harmful, offensive, or otherwise objectionable.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Upload or transmit viruses, malware, or other harmful code
- Scrape, crawl, or use automated means to access the Service without our written consent
- Reverse-engineer, decompile, or disassemble any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Use the Service for any commercial purpose not expressly permitted by these Terms
We reserve the right to suspend or terminate your account if we reasonably believe you have violated any of these restrictions.
7. Intellectual Property
The Service — including its design, graphics, user interface, logos, trademarks, and underlying software — is the property of Packstack, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code of the software, unless applicable law permits it or you have our written permission.
8. Mobile Application
Your use of the Packstack mobile application is also subject to the terms and conditions of the platform from which you downloaded the app (e.g., Apple App Store or Google Play Store). In the event of a conflict between these Terms and any app store terms, these Terms shall govern your relationship with Packstack.
The mobile app may request device permissions such as camera access, photo library access, and push notifications. These permissions are optional and can be revoked at any time through your device settings. We do not guarantee compatibility with all devices or operating system versions.
9. Third-Party Services
The Service may contain links to or integrations with third-party websites or services. We do not endorse, control, or assume responsibility for any third-party content, products, or services. Your interactions with third-party services are governed by their own terms and policies.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy, reliability, or completeness of any content available through the Service. You use the Service at your own risk.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACKSTACK, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total aggregate liability for any claims arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to Packstack in the twelve (12) months preceding the event giving rise to the claim, or $50.00, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Packstack, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
13. Termination
You may stop using the Service at any time. You may also request deletion of your account by contacting us at jerad@packstack.io.
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. Deletion of your data will be handled in accordance with our Privacy Policy.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.
15. Dispute Resolution
If you have a dispute with Packstack arising out of or relating to these Terms or the Service, you agree to first attempt to resolve it informally by contacting us at jerad@packstack.io. We will try to resolve the dispute within thirty (30) days of receiving your notice.
If the dispute is not resolved informally within that period, either party may bring a claim in the state or federal courts located in the State of Delaware. You and Packstack each consent to the exclusive jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Effective Date" at the top of this page and, where appropriate, through a notice within the Service. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
