Terms of Service

1. Acceptance of Terms

Packstack, LLC ("Packstack," "we," "us," or "our") operates the website www.packstack.io, the web application at app.packstack.io, and the Packstack mobile apps for iOS and Android (collectively, the "Service").

By using the Service, you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old to use the Service, and by using it you confirm that you are.

2. The Service

Packstack is a gear list and pack weight platform for backpackers and hikers. It lets you build a gear closet, create and share packing lists, plan trips, track pack weight, and connect AI assistants to your account, through our website, web app, and mobile apps.

3. Accounts

Most features require an account. You can sign in with a one-time code sent to your email address, or with Google or Apple. You are responsible for keeping access to your email and sign-in accounts secure, and for all activity under your Packstack account. Tell us right away at support@packstack.io if you suspect unauthorized use.

Each person may have only one account. We may suspend or remove duplicate accounts.

4. Packstack Pro and Purchases

Packstack offers a free tier and a paid tier, Packstack Pro. Pro is available as a monthly subscription, an annual subscription, or a one-time purchase. The price and what Pro includes are shown before you buy, and may vary by platform and region. We may change the limits of the free tier and the features included in Pro over time.

Purchases through the App Store or Google Play. These are billed to your Apple or Google account. Subscriptions renew automatically at the end of each period unless you turn off auto-renewal at least 24 hours before the period ends. You can manage or cancel them in your App Store or Google Play account settings; deleting the app or your Packstack account does not cancel them. Refunds are handled by Apple or Google under their policies.

Purchases on the web. These are billed through our payment processor. Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time from Settings in the web app, under Manage subscription. Except where the law requires otherwise, web purchases are non-refundable, and we do not give prorated refunds for partial periods.

Cancellation. When you cancel a subscription, you keep Pro until the end of the period you have paid for.

One-time purchase. A one-time purchase is not a subscription and does not renew. It unlocks Pro on your account for as long as we offer Packstack Pro.

Price changes. We may change subscription prices. We will give you at least 30 days' notice before a new price applies to your subscription, and the App Store and Google Play may also ask you to agree to the change. If you do not want to pay the new price, cancel before it takes effect.

5. Your Content

"Your Content" means anything you create, upload, or store in the Service, including gear, packing lists, trips, photos, and notes.

Ownership. You own Your Content.

License to us. You give Packstack a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute Your Content only as needed to operate and provide the Service.

Sharing. When you share a trip, anyone with the link can view it. Trips you publish may appear in public listings and in search engines, and your public profile can be viewed by anyone. You are responsible for what you choose to share.

Removal. We may remove content that violates these Terms or that we reasonably believe is harmful or objectionable.

6. Estimates Are Not Advice

Packstack shows estimates to help you plan, including calorie, food, and water targets, trail distances, elevation, terrain, and expected temperatures, product weights and specifications, and over-packing warnings. Some of this information is researched automatically, including with AI, and may be incomplete or wrong.

These estimates are for general planning only. They are not medical, nutritional, or safety advice. Backpacking and hiking carry real risks. Check trail and weather conditions with authoritative sources, carry enough food and water for your own needs, and consult a qualified professional about your health. You are responsible for your own preparation and safety.

7. AI Assistants and Other Third-Party Services

You can connect AI assistants, such as Claude or ChatGPT, to your Packstack account. When you do, you authorize that assistant to read your data and, if you have Pro, to make changes on your behalf, such as adding gear or building packs. Changes an assistant makes are treated as changes you made. You can disconnect an assistant at any time in Settings under Connected apps.

The Service may also link to or work with other third-party websites and services. We do not control them and are not responsible for their content, products, or services. Your use of them is governed by their own terms and policies.

8. Acceptable Use

You agree not to use the Service to:

We may suspend or terminate your account if we reasonably believe you have violated any of these restrictions.

9. Intellectual Property

The Service, including its design, graphics, user interface, logos, trademarks, and underlying software, belongs to Packstack, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer or attempt to extract its source code, unless the law permits it or you have our written permission.

10. Mobile Apps

Your use of the Packstack mobile apps is also subject to the terms of the store you downloaded them from (the Apple App Store or Google Play). If these Terms conflict with those store terms, these Terms govern your relationship with Packstack. We do not guarantee that the apps will work on every device or operating system version.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. We do not warrant the accuracy, reliability, or completeness of any content or estimate in the Service. You use the Service at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACKSTACK, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of the total amount you paid to Packstack in the twelve (12) months before the event giving rise to the claim, or $50.00.

13. Indemnification

You agree to indemnify, defend, and hold harmless Packstack, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected with your use of the Service, Your Content, or your violation of these Terms.

14. Termination

You may stop using the Service at any time, and you can delete your account yourself: in the mobile app under Account Details, or on the web in Settings. You can also ask us to delete it at support@packstack.io. Deleting your account does not cancel an App Store or Google Play subscription.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. When your access ends, your right to use the Service ends immediately. We handle deletion of your data as described in our Privacy Policy.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules.

16. Dispute Resolution

If you have a dispute with Packstack about these Terms or the Service, you agree to first try to resolve it informally by contacting us at support@packstack.io. We will try to resolve it within thirty (30) days of receiving your notice.

If it is not resolved within that time, either party may bring a claim in the state or federal courts located in the State of Delaware, and you and Packstack each consent to the exclusive jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the Effective Date above and, where appropriate, notify you in the Service. Your continued use of the Service after a change means you accept the updated Terms.
